Definitions and Parties

In short: These Terms are a contract between you and Kreosus (TREE OF EVOLUTION LLC). We added short summaries before each section to help you read it, but the full text is what legally matters.

Kreosus is operated by TREE OF EVOLUTION LLC (the "Company", "we", "us", or "our"). Our address is 1733 County Road 123, Gainesville, Texas, USA 76240. You can reach us at [email protected].

These Terms of Service ("Terms") apply to the Kreosus website, mobile apps, our embed/support module, and any other products or services we provide (collectively, the "Service").

When we say "Creator", we mean a person or legal entity that uses the Service to publish content and receive financial support. When we say "Supporter", we mean a person who uses the Service to financially support a Creator. "Content" means anything users post, upload, share, or otherwise make available through the Service, including text, images, audio, video, files, and messages.

By creating an account, clicking an "I agree" checkbox or button, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms and to our other policies that we publish (including our Privacy Policy and Community Guidelines).

Kreosus is a platform that helps Creators and Supporters find each other and process support payments. Creators and Supporters may make their own promises to each other. Except where we explicitly say otherwise, Kreosus is not a party to any agreement between a Creator and a Supporter, and we do not guarantee any Creator's content, rewards, promises, quality, legality, or delivery timing.

We may update these Terms from time to time. We also may change, add, or remove features of the Service. If we make a change that we consider material, we will provide notice (for example by email or within the Service) before the change takes effect. If you continue to use the Service after the updated Terms take effect, you are agreeing to the updated Terms. If you do not agree, you must stop using the Service.

Account Creation

In short: You must be old enough to use Kreosus, provide accurate information, and keep your account secure. We may ask for age, identity, and payout verification.
Eligibility and age limits

You must be at least 15 years old to create a Kreosus account. If you are between 15 and 17 years old, you may use paid features only with written permission from your parent or legal guardian, and you must provide proof if we ask. If you are under 15, do not create an account or use the Service.

Supporters

To support a Creator with a one-time payment or a recurring (monthly) payment, you must be at least 18 years old, or (if you are 15 to 17) you must have written permission from your parent or legal guardian. If you are 15 to 17, please provide proof of permission before making payments by emailing us. If you believe someone is using Kreosus in a way that violates these age rules, please contact us.

Creators

To create a Creator profile and request payouts, you must be at least 18 years old, or (if you are 15 to 17) you must have written permission from your parent or legal guardian and provide proof before you create your Creator profile. Please send proof by emailing us.

When you register, set up payouts, or request payouts, we may ask you for information (for example legal name, address, tax information, and government-issued identification). You must answer truthfully and keep your information up to date. If we believe information is false, misleading, or incomplete, we may suspend or terminate your account and we may delay or block payouts.

Organizations and authority

If you use the Service on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, "you" also refers to that entity.

Account security

You are responsible for keeping your login details (such as your username and password) confidential. You are responsible for all activity that happens through your account, whether or not you authorized it. If you believe your account has been compromised, please contact us immediately.

Community Guidelines

In short: Be safe and respectful. No illegal activity, harassment, fraud, or prohibited products and services. If you break these rules, we may remove content, freeze payouts, or terminate accounts.

You are fully responsible for what you do on Kreosus, including what you post, how you communicate, and what you collect money for. If we believe you are using the Service in an unacceptable way, we may remove content, limit features, suspend payouts, or terminate your account.

Examples of prohibited behavior
  • Illegal activity: Do not use Kreosus for anything illegal, and do not promote illegal activity.
  • Harassment and hate: Do not bully, harass, threaten, or abuse anyone. Do not incite violence. Do not post hate speech or content that promotes unlawful violence or discrimination against people based on protected characteristics.
  • Exploitation and sexual content: Do not post or sell pornography or sexually explicit content whose primary purpose is sexual gratification. Do not offer or request sexual services. Any sexual content involving minors is strictly forbidden.
  • Personal information: Do not dox people or share someone else's personal information without permission. Creators must not publish or sell Supporter information, and must not use Supporter data for spam.
  • Fraud and deception: Do not run scams, mislead people, or make false claims to collect money.
  • Impersonation: Do not pretend to be someone else, and do not create accounts for someone you do not represent.
  • Username squatting: Do not reserve usernames you do not have a legitimate right to use, and do not sell or attempt to sell usernames. We may reclaim usernames at any time.
  • Intellectual property: Do not post Content that infringes someone else's copyright, trademark, or other rights.
  • Spam: Do not send unsolicited promotions, repetitive messages, or irrelevant advertising through Kreosus.
  • Malware and security abuse: Do not upload malware, attempt to hack accounts, probe the Service, or interfere with our security.
  • Scraping and data mining: Do not scrape, harvest, or bulk-collect data from the Service (including via bots) without our written permission.
  • Service abuse: Do not interfere with the normal operation of the Service, overload our systems, bypass access controls, or help others do so.
  • False endorsement: Without our written permission, do not claim that Kreosus endorses or sponsors you, your Content, or your products.
  • Reward theft: Do not resell, redistribute, or leak Creator rewards or benefits without the Creator's written permission.
Prohibited products, services, and funding uses

Because we work with financial institutions and payment networks, some categories are not allowed on Kreosus even if they are legal in some places. You may not use Kreosus to fundraise for, sell, or facilitate:

  • Illegal drugs and drug paraphernalia (including products designed to mimic illegal drugs).
  • Cannabis and THC products (including marijuana, cannabis dispensaries, and CBD products that exceed local THC limits).
  • Tobacco and vaping products (including e-cigarettes and e-liquid).
  • Weapons, explosives, and dangerous materials (including illegal weapons and certain regulated weapons or accessories).
  • Adult services (including prostitution, escorts, pay-per-view sexual services, and other sexually explicit services).
  • Gambling and games of chance or skill where an entry fee or payment is made for the chance to win a prize of value (including lotteries, sweepstakes, and betting-related services).
  • Money services and certain financial products (including money transmission, currency exchange, cheque-cashing, debt collection, debt settlement, and similar services).
  • Cryptocurrency and token sales (including certain exchanges, ICOs, and tokenized investment schemes) unless we approve in writing.
  • Prescription drugs and regulated medical products (including prescription-only pharmaceuticals, regulated medical devices, and telemedicine services) unless we approve in writing.
  • Counterfeit goods, stolen goods, fake IDs, or other identity-related fraud.
  • Unfair or deceptive practices (including pyramid schemes, get-rich-quick schemes, and misleading high-pressure sales tactics).
  • Sanctions evasion and restricted persons or regions: You may not use Kreosus if you are subject to sanctions or located in a region that is broadly embargoed or sanctioned by the United States or other applicable authorities. You also may not use Kreosus to provide funds or services to sanctioned persons.

This list is not exhaustive. We may update these rules as laws and financial-network requirements change.

Supporters

In short: When you support a Creator, you are paying that Creator. We help process payments and provide platform tools, but Creators are responsible for what they offer and deliver. You can cancel recurring pledges at any time, but refunds are usually handled by the Creator.

Supporters use Kreosus to financially support Creators. Support can be a one-time payment and/or a monthly recurring payment. You can support one or more Creators.

Support payments are generally not charitable donations and are not tax-deductible. Unless a Creator clearly tells you otherwise and has the legal status to receive deductible donations, you should treat support as a purchase of access/benefits or as general support for a Creator.

Creators may offer benefits, rewards, or other promises to Supporters. Those offers are made by Creators, not by Kreosus. Kreosus is not an online store and we are not the seller of Creator benefits. Kreosus is not responsible for any reward, delivery, quality, or promise made by a Creator. If you have questions about a Creator's benefits, please contact the Creator.

We may review accounts and investigate reports, but we cannot guarantee that every Creator claim is accurate. You are responsible for deciding whether to support a Creator.

To start supporting Creators, you must create a Kreosus account. You do not need to enter payment details to create an account. Payment details are requested only when you choose to make a payment.

Types of support

There are two main types of support on Kreosus: One-Time and Monthly (Recurring). You choose which one to use during checkout.

One-Time payments: If you choose a one-time payment, we will charge your payment method on the day you confirm the payment. After applicable fees and taxes, the remaining amount is credited to the Creator's balance. You will be charged only once unless you make another one-time payment.

Monthly (Recurring) payments: If you choose monthly support, we will charge your payment method on the day you start the pledge. After that, we will attempt to charge the same amount on the first day of each month until you cancel. If a monthly charge fails, we may retry up to two more times in the same month (typically on the ninth and sixteenth day). Once a charge succeeds, we will not retry again for that month. If your monthly pledge fails for three consecutive months, we may automatically cancel it. We will try to notify you about failed charges by email.

You may cancel your pledge or change the amount you pledge at any time. Changes usually apply to future charges. Canceling stops future charges, but does not automatically refund past charges (except where required by law).

Canceling a pledge may affect your access to a Creator's gated content or benefits. Some Creators may remove access immediately, while others may keep access until the end of a billing period. Kreosus does not control these Creator decisions.

Bank fees and foreign transaction fees

Some banks may add extra fees (often called a foreign transaction fee). Kreosus charges the amount you agree to pay (plus any taxes shown at checkout). Any extra bank fee is set by your bank and is outside our control.

Taxes

Depending on your location, taxes such as VAT, GST, or sales tax may apply. If we are required to collect a tax, it will be shown during checkout. You are responsible for providing accurate location and billing information. If you provide false information, you may face consequences under local law.

Refunds and disputes

Refunds are primarily handled between you and the Creator. If you want a refund, please contact the Creator first. Kreosus may be able to process refunds only in limited situations (for example, where required by law, to correct a clear error, or to address fraud), and we may refuse refund requests that are not required by law.

If you file a chargeback or payment dispute with your bank, we may share information about the transaction with our payment processors and banks as needed to respond. Excessive chargebacks may result in account limits or termination.

Kreosus is not responsible for the quality, timeliness, or legality of Creator content or benefits. If you believe a Creator is acting fraudulently, please report it to us.

Content Creators

In short: Creators are responsible for their content, benefits, and promises. We facilitate payments and payouts, but we can delay or block payouts for compliance, fraud prevention, disputes, or policy violations.

Creators use Kreosus to receive support from their audience for content they create online or in real life. Creators may be individuals or legal entities (such as companies or nonprofits).

Kreosus does not guarantee that a Creator will earn any amount of money, meet minimum wage, or gain any number of Supporters. You are responsible for how you present your work, what you offer, and how you run your Creator page.

You may create one or more Creator profiles under your account (for example, separate profiles for different projects). You are responsible for everything published and offered through each Creator profile you control.

Payment facilitation and payouts

Kreosus helps process payments from Supporters and helps send payouts to Creators. We and our payment partners may hold funds for a period of time before payouts are completed. Kreosus is not a bank and does not provide banking services. Funds held for payout are not insured and do not earn interest for you.

To receive payouts, you may be required to set up an account with one or more of our payment processors or financial partners and agree to their terms. You authorize us to share the information you provide with those partners for identity verification, fraud prevention, payout processing, and legal compliance.

As an intermediary, Kreosus does not "own" funds that Supporters pay for Creators, but we may temporarily hold or restrict funds to operate the Service, prevent fraud, cover refunds and chargebacks, and comply with legal obligations.

Your access to payouts may be delayed, limited, or blocked for reasons including: failed verification, suspected fraud, chargebacks or disputes, negative balances, policy violations, legal or regulatory requirements, tax or reporting requirements, or requests by authorities. Where practical, we will notify you about payout delays or blocks.

If you believe a payout is missing or incorrect, please contact Kreosus. Do not contact Supporters for payout issues, because Supporters do not control payouts once a payment has been made.

Your obligations to Supporters

You are solely responsible for: (i) the Content you post, (ii) the benefits or rewards you offer, and (iii) delivering those benefits. If you offer physical goods, services, or time-based benefits, you are responsible for shipping, customer service, returns, and any applicable consumer protection requirements. Kreosus is not responsible for your fulfillment.

You must describe your benefits accurately and must not mislead Supporters. You must not offer benefits that are illegal, infringe others' rights, or violate these Terms.

Supporter information

Creators may have access to limited Supporter information through the Service. You may use that information only to: (i) communicate with Supporters about your Creator page, and (ii) deliver benefits. You must not sell, rent, or share Supporter information, and you must not use it for unsolicited marketing outside Kreosus unless the Supporter has clearly opted in.

Fees

In short: Fees keep Kreosus running. There are payment processing fees, a Kreosus platform fee, and payout (transfer) fees. Fees and taxes can change, and refunds/chargebacks reduce a Creator's balance.

There are three types of fees on Kreosus:

  • 1. Payment processing fees (also called transaction fees)
  • 2. Platform fees (also called Kreosus fees)
  • 3. Payout fees (also called transfer fees)
How fees are applied

The general order is:

  • We start with the pledge amount plus any applicable taxes.
  • Our platform fee is deducted from this amount.
  • Payment processing fees are then deducted.
  • The remaining amount is credited to the Creator's Kreosus balance.
  • When a payout is sent, a payout fee may be deducted from the Creator's balance.
Payment processing fees

Payment processing fees are set by our payment processors and may vary by payment method, currency, and country. These fees are typically a percentage plus a fixed amount per transaction. We do not control these fees, but we may display estimates or the actual fee impact in checkout and Creator dashboards.

Platform fee

To operate and improve the Service, Kreosus uses a progressive fee structure based on the Creator's lifetime earnings. Rates range from 0% to 10% depending on total earnings, with separate tier brackets for USD and TRY accounts. The first tier is completely fee-free, and once earnings exceed that threshold, fees apply according to the next bracket. Since tiers are based on lifetime earnings (not monthly), they do not reset. Even our highest tier (10%) remains competitive with industry standards, which can exceed 25%. Current tier details are available in our FAQ. We may change our fees with notice through the Service.

Bundled charges to reduce fees

To reduce payment processing fees, we may bundle a Supporter's monthly pledges to multiple Creators into a single charge. In that case, payment processing fees are allocated across Creators proportionally based on each Creator's share of the total pledge. This is designed to reduce overall processing fees and benefits Creators.

Bank fees and currency conversion

Some banks charge Supporters additional fees (often around a few percent) for certain international or online transactions. Those bank fees are outside our control and do not affect the amount credited to a Creator. If currency conversion is involved (by a bank or processor), conversion fees and exchange rate adjustments may also apply.

Payout fees

When a Creator requests a payout (or when automatic payouts occur), a payout fee may apply based on the payout method selected in the Creator's payout settings. Payout fees are generally set by banks or payout networks and are outside our direct control.

Taxes

Kreosus does not provide tax advice. Creators are responsible for reporting and paying income taxes, and for complying with tax rules in their country. We may collect and remit certain consumption taxes (such as VAT, GST, or sales tax) when required. If we collect such a tax, it will be shown during checkout.

Refunds, chargebacks, and negative balances

If a payment is refunded or disputed (including chargebacks), the refunded amount, dispute amount, and any related fees may be deducted from the Creator's Kreosus balance. Payment processing fees are often not returned to us when a payment is refunded or charged back, so refunds and chargebacks may cost more than the original pledge amount. If your balance becomes negative, we may recover the amount from future earnings and may delay payouts until the negative balance is resolved.

Prohibited fundraising and payout activity

Kreosus cannot be used for certain high-risk or prohibited activities. In addition to the Community Guidelines, Creators are strictly prohibited from using Kreosus to collect funds for or deliver benefits related to:

  • pornography or sexually explicit content created for sexual gratification,
  • sexual services (including prostitution and escort services),
  • content that is illegal where you live or where you operate,
  • paramilitary or armed groups acting against lawful governments,
  • gambling, lotteries, raffles, or drawing-based reward systems,
  • illegal drugs, drug paraphernalia, or controlled substances,
  • weapons, explosives, or dangerous materials,
  • transactions that violate sanctions, embargoes, or anti-money laundering laws,
  • copyright-infringing or counterfeit content, unless you have permission or a valid legal exception.

We may refuse to process payments or payouts, suspend accounts, or remove Content if we believe an activity creates legal, financial, or reputational risk to Kreosus or our payment partners.

The Role of Kreosus

In short: Kreosus is the platform and payment facilitator, not the Creator. We do not endorse Creator content. We may review and remove content and we may change features over time.

Kreosus brings Creators and Supporters together and provides tools for publishing, communication, and payment facilitation. Beyond that limited role, we do not control and are not responsible for agreements between Creators and Supporters.

We do not endorse, sponsor, or verify any Creator's content or claims. The presence of a Creator or Creator content on Kreosus does not mean we approve it.

Content moderation and enforcement

If you encounter Content that violates these Terms, please report it to us. We may investigate reports, remove Content, limit features, suspend payouts, or terminate accounts. We try to be careful and consistent, but we may need to act quickly to protect users, comply with law, or prevent harm.

In serious situations, we may preserve information and cooperate with law enforcement or other authorities as required by law.

Support module and cookies

We may provide Creators with an HTML embed ("Support Module") that can be added to external websites to let Supporters find and use Kreosus. The Support Module may use cookies or similar technologies to function properly and to help us understand performance. We use this information to operate and improve the Service.

Except for the Support Module and standard web technologies needed to deliver the Service, we do not install software on your device. A Support Module on an external website does not mean Kreosus endorses that website or its content.

Experiments and beta features

We may test new features, change existing features, or limit features to certain users. If a change is likely to materially affect your use of the Service, we will try to provide notice to affected users.

Optional sharing and promotional features

With your explicit permission, we may share limited profile information with third-party services for verification, promotions, or integrations. Examples may include the Creators you support, the total amount you pledged, the length of your Kreosus membership, the length of your pledge to a specific Creator, how many Supporters a Creator has, and the total amount of support a Creator has received. We will ask for permission in a clear way before we do this. You can withdraw permission going forward, but you cannot recall information already shared.

Security

We use reasonable security measures designed to protect the Service. For example, we do not store full payment card numbers on our own servers. However, no service can be guaranteed to be 100% secure. To the maximum extent permitted by law, we are not responsible for security incidents that are outside our reasonable control.

Account Termination

In short: You can close your Kreosus account, but make sure you cancel any recurring pledges first. We may also suspend or terminate accounts. Some parts of these Terms continue even after an account is closed.

You can close your Kreosus account through your profile settings or by contacting us.

Please review our Privacy Policy to learn what data we delete, what data we keep for legal or operational reasons, and how long we retain it.

If you are a Supporter, closing your account does not guarantee an immediate refund. If you have active recurring pledges, you should cancel them before closing your account to avoid future charges.

If you are a Creator, closing your account may stop payouts and may remove access to Creator tools. We may hold funds for a reasonable period to cover refunds, chargebacks, disputes, and legal compliance.

We may suspend or terminate your account at any time, with or without notice, if we believe you violated these Terms, if required by law, or to protect the Service. We may also cancel, reverse, or refund payments when needed (including to address fraud or disputes).

Sections that by their nature should survive termination (for example, content licenses, disclaimers, limitations of liability, and dispute provisions) remain in effect after your account is closed.

Content

In short: You keep ownership of your Content, but you give Kreosus permission to host, display, and share it so the Service works and so we can promote Creators and Kreosus. Only upload Content you have the right to use.
Your Content and your responsibility

You keep ownership of the Content you create and post on Kreosus. You are responsible for your Content and for ensuring that you have all rights needed to post it (including copyright, trademark, and privacy rights). You must not post Content that infringes someone else's rights.

License you grant to Kreosus

When you post or upload Content to Kreosus, you grant Kreosus a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, distribute, publicly display, publicly perform, and make technical modifications to your Content for the purpose of operating, improving, and promoting the Service and Creator pages. This includes the right to make your Content available to Supporters and other users according to your settings and the features of the Service.

This license continues for as long as your Content is on the Service. If you remove Content, the license generally ends within a reasonable time, except that: (i) we may keep copies for backups, security, and legal compliance, and (ii) if your Content was used in marketing or shared publicly (for example, in a social post or a screenshot), those uses may continue.

Supporter access and restrictions

Creators may share Content or rewards with Supporters. Supporters receive a limited, personal, non-transferable right to access that Content for their own use. Supporters may not copy, redistribute, resell, publish, or create derivative works from Creator Content unless the Creator gives written permission or the law clearly allows it.

Contents of Kreosus

In short: Kreosus owns its own site, code, design, and trademarks. You can use Kreosus normally, and you may use our logo to point people to your Kreosus page, but you cannot reuse our materials outside Kreosus without permission.

The Service, including our website content, software, code, design, and trademarks (including the Kreosus name and logo), is owned by the Company or its licensors and is protected by intellectual property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for its intended purposes. Except for that limited license, you may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from any Kreosus content or software.

You may use the Kreosus name and logo solely to promote your Kreosus Creator page or to link to Kreosus, as long as your use is accurate and does not suggest endorsement by Kreosus.

Feedback

If you send us suggestions, ideas, or feedback about the Service, you agree that we can use it without restriction and without compensation to you.

Copyright and Violations

In short: If you believe something on Kreosus infringes your copyright, email us or send a written notice with the required details. If you believe your Content was removed by mistake, you can send a counter-notice.

You can also contact us by email. To help us respond quickly, your notice should include:

  • Your physical or electronic signature (or the signature of someone authorized to act for you),
  • Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are involved),
  • Identification of the infringing material and where it appears on Kreosus (a URL or other specific location information),
  • Your name, address, telephone number, and email address,
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law,
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.
Counter-notification

If you believe your Content was removed or disabled by mistake or misidentification, you may send a counter-notice to the same contact address above. Your counter-notice should include:

  • Your physical or electronic signature,
  • Identification of the material that was removed or disabled and the location where it appeared before it was removed,
  • A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification,
  • Your name, address, telephone number, and email address,
  • A statement that you consent to the jurisdiction of the federal court in the Eastern District of Texas (or, if you are outside the United States, an appropriate United States jurisdiction) and that you will accept service of process from the person who provided the original notice or that person's agent.

We may terminate accounts of repeat infringers in appropriate circumstances. We may also remove or restrict Content to comply with law or to protect users.

Compensations and Damages

In short: If your actions or Content cause Kreosus to get sued or incur costs, you agree to cover those costs (including reasonable legal fees).

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless the Company, its affiliates, and their directors, officers, employees, contractors, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use of the Service, (ii) your Content, (iii) your breach of these Terms, or (iv) your violation of any law or rights of a third party.

We may, at our option, assume the exclusive defense and control of any matter subject to indemnification by you. In that case, you agree to cooperate with our defense.

Operational Disclaimer

In short: We work hard to keep Kreosus running, but we cannot promise perfect uptime or error-free service.

The Service is provided on an "as is" and "as available" basis. We do our best to keep the Service accessible, but interruptions can happen due to maintenance, security issues, capacity limits, third-party outages, or events outside our control (for example, internet failures, power outages, natural disasters, or acts of war).

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

By using the Service, you agree that you will not seek damages from us solely due to temporary unavailability or technical issues, except where the law does not allow this limitation.

Limits of Responsibility

In short: If you lose money or miss out on a Creator reward, that is usually a dispute between you and the Creator. Kreosus' liability is limited as much as the law allows.
No liability for Creator promises

Kreosus is not responsible for a Creator's promises, rewards, delivery timing, quality, or legality. Disputes between Supporters and Creators should be resolved between those parties.

Limitation of liability

To the maximum extent permitted by law, Kreosus and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to the Service.

To the maximum extent permitted by law, Kreosus' total liability for any claim arising out of or related to the Service will not exceed the greater of: (i) the total platform fees Kreosus earned from your use of the Service in the 12 months before the event giving rise to the claim, or (ii) USD $100.

Some jurisdictions do not allow certain liability limitations. In that case, our liability will be limited to the maximum extent permitted by applicable law.

Third-party links and services

The Service may include links to third-party websites or services. We do not control those third parties and are not responsible for their content, policies, or practices. If you access third-party websites, you do so at your own risk.

Data and security incidents

We use reasonable measures to protect data, but no system is perfectly secure. To the maximum extent permitted by law, we are not liable for security incidents that are outside our reasonable control.

Conflict Resolution

In short: If there is a problem, contact us first so we can try to fix it. Disputes must be brought individually, not as a class action, and you waive a jury trial to the extent the law allows.

Either party may bring an eligible claim in small claims court instead of the restrictions in this section, as long as the claim stays in small claims court and is brought on an individual basis.

To the maximum extent permitted by law, you and Kreosus agree that any dispute, claim, or controversy arising out of or relating to the Service must be brought on an individual basis. Class actions, class arbitrations, private attorney general actions, and other representative proceedings are not allowed.

To the maximum extent permitted by law, you and Kreosus waive the right to a trial by jury for any dispute arising out of or relating to the Service.

This section does not limit either party's ability to seek injunctive or other equitable relief for disputes relating to intellectual property, unauthorized access, or misuse of proprietary data.

Governing Law

In short: These Terms are governed by Texas law, and disputes must be resolved in Texas courts (Cooke County for state court, and the Eastern District of Texas for federal court).

Texas law, excluding its conflict-of-law rules, governs these Terms and all disputes between you and Kreosus relating to the Service.

Except where prohibited by law, you and Kreosus agree to the exclusive jurisdiction and venue of: (i) the state courts located in Cooke County, Texas, USA, and (ii) the United States District Court for the Eastern District of Texas (Sherman Division) for any federal court claims.

Other Clauses

In short: A few final legal basics: these Terms are the whole agreement, if one part is invalid the rest still applies, and we can send you notices electronically.

These Terms and any policies referenced in them are the entire agreement between you and Kreosus regarding the Service and supersede any prior agreements or communications.

If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable. If it cannot be modified, it will be severed, and the remaining provisions will remain in effect.

If either party does not enforce a right under these Terms, that does not waive that right.

We may assign these Terms (including our rights and obligations) to an affiliate or as part of a merger, acquisition, sale of assets, or similar transaction. You may not assign these Terms without our written consent.

You agree that we may provide notices and communications to you electronically (for example, by email, through the Service, or by posting updated Terms). It is your responsibility to keep your contact information up to date.

Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and Kreosus.
